Two Charged with Murder in Dayton Shooting
DAYTON, July 5, 2014 – At around 10:15 pm Friday evening, a shooting at the Double “B” Oaks Club located at 5999 Hwy. 146 approximately five miles South of Dayton, Texas, resulted in the death of a white female identified as Yolanda Santos age 46 of Pasadena.
Investigators, who are in the process of interviewing witnesses, said that from preliminary interviews there may have been a confrontation between the victim and a male subject while inside the club. At some point the victim went outside and into the parking lot where shots were heard. Witnesses are said to have observed a white male standing over the woman firing several shots at her. Two male subjects then fled the scene going North on Hwy. 146 towards Dayton in a gray Dodge pick-up truck.
A few minutes later, Dayton Police Corporal Eric Ibarra and Officer Barry Leger stopped the vehicle on Hwy. 90 at FM 1409. The occupants resisted but were later detained for the Liberty County Sheriff Department Investigators. At this time both subjects are being detained and interviewed by investigators in an attempt to determine the motive for the shooting as well as any possible relationship between the victim and the subject(s) who may have done the actual shooting.
It was later reported the female victim died as a result of the gun shot wounds at Memorial Herman Hospital after being transported there by Herman Life Flight.
Due to the fact, according to Sgt. Bortz, the two arrested subjects, Bobby Smith, age 52 of the Dayton area and his brother, Tracy Lee Thorn, age 56 who is said to live in San Antonio were intoxicated at the time they were arrested and the further problem of Bobby Smith threatening jail personnel and arresting Officers with bodily harm if given the opportunity, some details of the investigation are still not clear. Sgt. Bortz did, however, confirm that a 9mm semi-automatic was found in Smith’s vehicle and it is thought he was the actual shooter. Both Smith and Thorn are refusing to cooperate with the investigators which has prevented either of them from being brought before a Judge for a bond as both Smith and Thorn have been charged with murder.
According to Sgt. Bortz, he has not been able to determine any motive for this shooting as Ms. Santos has been an employee at the Oaks Club for almost a year and was very well liked by everyone. Witnesses were only able to furnish information that Ms. Santos was told that Bobby Smith wanted to talk to her in the parking lot and when she went outside, the gunshots were heard. None of the customers are aware of any argument or confrontation that had occurred inside the Club so, at this point, there is no logical explanation for the shooting.
