Hardin Man Charged in Death of Four Week Old Baby
AUSTIN, March 21, 2014 - On Thursday, March 20, 2014 and after a very extensive and in depth investigation by Sgt. Investigators Josh Cummins and Stephen Clappart of the Liberty County Sheriff’s Department, a Liberty County Grand Jury returned an indictment of “Capital Murder of a person under 10 years of age” on Brian Christopher Keith age 29 of the Hardin, Texas area. The Grand Jury indictment was served earlier this morning on Keith who was already in the Liberty County jail on other charges.
On July 2, 2013, little four (4) week old Nevaeh (“ Heaven” spelled backwards) Keith was found non-responsive and later pronounced deceased, in her bed at her home on CR 2061 in Liberty County. During the initial investigation it was found that Brian Keith had been released from prison nine (9) days earlier and was on parole for an arson conviction when his wife, Shanna Keith, gave birth to little Nevaeh Keith. It is alleged that Brian Keith fostered a great deal of resentment towards the baby because it was not his child.
During the early stage of the death investigation, Keith admitted to Investigators that he had gotten up at 4:am on the morning of July 2nd to go to work and little Nevaeh was crying. He admitted to “patting the child on the head and maybe striking the baby” and then he left for work while his wife was still asleep. Around 11:am that same morning, CPS workers came to the home to take Shanna Keith to a treatment facility when the baby was found to be non-responsive and 911 was then called.
The autopsy results indicated the baby died by “Compression Death” which is, in effect, death due to a blunt trauma to the body.
Within a few days of little Nevaeh’s death, Brian Keith was arrested for a “road rage” incident and placed in the county jail on an Assault charge. He was later released on probation for this offense but was re-arrested on a probation violation and was in the Liberty County jail for this offense when Investigators filed a Capital Murder charge on him for the death of baby Nevaeh. Brian Keith was still in the county jail when Sgt. Clappart and Sgt. Cummins served him with the Grand Jury Murder Indictment this morning.
The charges for this offense was filed in Judge Mark Morefield’s 75th District Court and no bond is being set at this time.
