House Bill 338 Amends Hearing Jurisdiction For Towing and Booting

AUSTIN August 5, 2013 - House Bill 338, passed by the 83rd Texas Legislature, amended Chapter 2308 of the Texas Occupations Code relating to the regulation of towing and booting in Texas. The bill amended the hearing jurisdiction to include any justice court in the county from which the motor vehicle was towed.

The bill also includes an amendment to Contents of Notice (Section 2308.455 (5)), requiring the vehicle storage facility to include the name, address, and telephone number of every justice court in the county from which the vehicle was towed or booted. This information is to be included in the Notice to Vehicle Owner or Operator and to the owner upon release of the vehicle. This list of justice courts may be linked to the Internet website maintained by the Office of Court Administration of the Texas Judicial System. The amendments to Chapter 2308 became effective June 14, 2013.
